TERMS OF SERVICE
Last updated: October 29, 2026
These terms explain how you can use our website and how we work with clients on projects.
1. About these terms
These Terms of Service apply to your use of thewebsitedesign.studio and to the services provided by Emrah Avci LLC, a New Mexico limited liability company doing business as The Website Design Studio LLC (“The Website Design Studio,” “we,” “us,” or “our”). By using this website or our services, you agree to these terms.
2. Using this website
You may use this website for lawful purposes only. You agree not to misuse it, for example by attempting to disrupt it, gain unauthorized access, send spam through our contact form, or submit harmful content.
3. Information and prices on this website
The information on this website is provided for general purposes. Prices shown are starting prices in US dollars for the starting scope described for each service; they are not binding offers. The final scope, schedule, and total price of a project are confirmed in a written proposal. We may update the content and prices on this website at any time.
4. Proposals and project agreements
Each project is based on a written proposal that describes the deliverables, schedule, price, and payment terms. When you accept a proposal, the proposal and these terms together form our agreement. If the proposal states something different from these terms, the proposal applies.
5. Payment
Payment terms are confirmed in your proposal. Unless your proposal states otherwise, we ask for a 50% upfront payment before work begins, and the remaining balance is due after the work has been completed and delivered.
We may pause work if a payment is overdue. Costs of third-party products and services, such as domain names, paid licenses, app store developer accounts, or advertising budgets, are your responsibility unless your proposal states that they are included.
6. Your responsibilities
To keep your project on schedule, you agree to provide the content, materials, feedback, approvals, and account access we need in a timely way. You confirm that you have the right to use any materials you give us, such as texts, images, and logos. Delays in receiving these may change the schedule.
7. Reviews and changes in scope
Review stages and the scope of revisions are confirmed in your proposal. New pages, features, or a changed direction may require an updated scope and price, which we agree with you before the additional work begins.
8. Intellectual property
The content of this website, including its text, design, and graphics, belongs to us or our licensors and may not be copied without permission.
Ownership and usage rights for project deliverables are confirmed in your proposal. Unless your proposal states otherwise, once the project has been paid in full, you may use the final deliverables of your project for your business. Third-party elements, such as stock images, fonts, or software components, remain subject to their own licenses. We keep the rights to our pre-existing tools, code, and methods.
Unless you ask us in writing not to, we may show completed work in our portfolio and on our website.
9. Hosting, support, and third-party services
Where hosting, support, or maintenance is included in a service, it is provided as described on the relevant service page and in your proposal. We rely on third-party providers for some services and are not responsible for their outages, policy changes, or decisions, such as app store review decisions.
10. No guarantee of specific results
We provide our services with reasonable care and skill. However, we do not guarantee specific results, such as search engine rankings, website traffic, sales, or app store approval. This website is provided “as is,” without warranties of any kind, to the extent permitted by law.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, such as lost profits or lost data. Our total liability for any claim related to a project is limited to the amount you paid us for that project in the twelve months before the claim.
12. Cancellations and refunds
Cancellations and refunds are handled as described in our Refund & Cancellation Policy.
13. Sanctions and export compliance
Emrah Avci LLC is a United States company and complies with U.S. economic sanctions and export control laws, including those administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC). We do not provide services to, enter into agreements with, or accept payments from (a) any person or organization located, organized, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions, or (b) any person or organization named on a U.S. government restricted-party list, such as OFAC’s Specially Designated Nationals and Blocked Persons List, or owned or controlled by such a party. By requesting a proposal or engaging our services, you confirm that neither you nor anyone you represent falls into these categories. We may decline, suspend, or end a project, and may refuse a payment or take any other step these laws require.
14. Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in New Mexico, unless we agree otherwise in writing.
15. Changes to these terms
We may update these terms from time to time. The version on this page applies from the date shown at the top. Projects already under way continue under the terms in effect when their proposal was accepted, unless we agree otherwise.
